FG Charges Globacom, Ex-CEO For Base Stations Installation Violation

The National Environmental Standards and Regulations Enforcement Agency (NESREA) has filed criminal charges against Globacom Nigeria Limited before the Federal High Court in Lagos for allegedly violating base transceiver station regulations.

The Indigenous telecommunications firm was charged before Justice Ayokunle Faji alongside its former Chief Executive Officer, Ahmad Farroukh, by the Federal Government agency for allegedly failing to comply with the enforcement notices issued by NESREA on March 21, 2024.

Specifically, NESREA, in the two-count charge, numbered FHC/L/967c/2024, accused the defendants of operating over 7,000 base transceiver stations nationwide without conducting the required Environmental Audits and submitting the necessary Environmental Audit Reports for the years 2024 to 2027

The prosecutor, Maria Telnumun, the agency’s Director of Legal Services, the alleged offences contravene Sections 5(2) and 27(1)(b) of the National Environmental (Standards for Telecommunications and Broadcast Facilities) Regulations 2011.

Telnumun also claimed the offences are punishable under Section 1(1)(2) and Section 28(2) of the same regulations.

During a court session on February 20, 2025, neither the defendants nor their legal representative appeared, prompting the court to adjourn the case until May 8 for the defendants’ plea to be taken.

The charges against the company and its CEO state: “That you, Globacom Nigeria Limited and Ahmad Farroukh, both located at No. 1 Mike Adenuga Close, Off Adeola Odeku Street, Victoria Island, Lagos State, on or about March 21, 2024, operated over 7,000 base transceiver stations nationwide without conducting the required Environmental Audit and submitting the necessary Environmental Audit Reports for the period 2024-2027, contrary to Section 5(2) of the National Environmental (Standards for Telecommunications and Broadcast Facilities) Regulations 2011 and punishable under Section 1(1)(2) of the same regulations.

“That you, Globacom Nigeria Limited and Ahmad Farroukh, both at No. 1 Mike Adenuga Close, Off Adeola Odeku Street, Victoria Island, Lagos State, on or about March 21, 2024, constructed over 7,000 base transceiver stations nationwide within the jurisdiction of this Honourable Court and failed to comply with the requirements of enforcement notices issued by the National Environmental Standards and Regulations Enforcement Agency (NESREA), contrary to Section 27(1)(b) of the National Environmental (Construction Sector) Regulations 2011 and punishable under Section 28(2) of the same regulation.”
